為提高低(di)收入勞動者收入水平(ping),充分發(fa)(fa)揮最(zui)(zui)(zui)低(di)工(gong)資的(de)保障作用(yong),根據《廣(guang)(guang)東(dong)省(sheng)(sheng)工(gong)資支付條例》、《廣(guang)(guang)東(dong)省(sheng)(sheng)人民政府關于調(diao)整廣(guang)(guang)東(dong)省(sheng)(sheng)最(zui)(zui)(zui)低(di)工(gong)資標(biao)準的(de)通(tong)知》,廣(guang)(guang)州(zhou)市人力資源和(he)社會保障局發(fa)(fa)布了(le)《關于調(diao)整廣(guang)(guang)州(zhou)市最(zui)(zui)(zui)低(di)工(gong)資標(biao)準的(de)通(tong)知》。有關事項(xiang)通(tong)知如下:
一、從(cong)2021年12月1日(ri)起,廣州市全日(ri)制就(jiu)業(ye)(ye)勞動者最(zui)低工資標(biao)準調整為2300元(yuan)/月,非全日(ri)制就(jiu)業(ye)(ye)勞動者最(zui)低工資標(biao)準調整為22.2元(yuan)/小時(shi)。
二(er)、在(zai)勞(lao)(lao)動(dong)(dong)者提供(gong)正常勞(lao)(lao)動(dong)(dong)的情況下,用人單位(wei)應(ying)支付(fu)給勞(lao)(lao)動(dong)(dong)者的工資(zi)(zi)在(zai)剔除(chu)下列各項以后,不(bu)得(de)低于當地最低工資(zi)(zi)標(biao)準:
(一)延長(chang)工作時間工資;
(二(er))中(zhong)班、夜班、高(gao)溫、低(di)溫、井下、有毒有害等特殊工作環境、條件下的津貼(tie);
(三)法律、法規和(he)國家(jia)規定(ding)的勞動者福利待遇等(deng)。
三(san)、實(shi)行計件(jian)工(gong)資形(xing)式的用人單位(wei),在科學(xue)合理確定勞動定額和計件(jian)單價(jia)的基礎上,勞動者(zhe)(zhe)在法定工(gong)作(zuo)時間內提供(gong)正(zheng)常勞動的前提下,支付勞動者(zhe)(zhe)的工(gong)資不得低于當地最低工(gong)資標準。
四、健(jian)全(quan)最(zui)低(di)(di)工資和支(zhi)付保(bao)障制度,推動將不(bu)完全(quan)符合確立勞(lao)動關系情形的新就業(ye)(ye)形態勞(lao)動者(zhe)納入制度保(bao)障范(fan)圍。督促企業(ye)(ye)向(xiang)提供正常勞(lao)動的勞(lao)動者(zhe)支(zhi)付不(bu)低(di)(di)于當地最(zui)低(di)(di)工資標準(zhun)的勞(lao)動報酬,按時足額支(zhi)付,不(bu)得克扣或者(zhe)無(wu)故拖欠。
五、各(ge)區、各(ge)單位要(yao)嚴(yan)格(ge)執行(xing)最(zui)低(di)(di)工(gong)資(zi)保障(zhang)制度(du)(du)。做(zuo)好宣傳解讀(du),對于推動(dong)將(jiang)不完(wan)全符合(he)確立勞(lao)動(dong)關系情(qing)(qing)形(xing)的新(xin)(xin)就業形(xing)態勞(lao)動(dong)者納入最(zui)低(di)(di)工(gong)資(zi)制度(du)(du)保障(zhang)范圍等新(xin)(xin)要(yao)求,要(yao)切(qie)實(shi)(shi)加大宣傳引導力度(du)(du)。加強檢查監督,暢通舉(ju)報投訴渠道,密(mi)切(qie)關注新(xin)(xin)就業形(xing)態領域落實(shi)(shi)情(qing)(qing)況,對違(wei)反最(zui)低(di)(di)工(gong)資(zi)規定、超(chao)時加班等違(wei)法(fa)行(xing)為依法(fa)嚴(yan)肅查處,確保最(zui)低(di)(di)工(gong)資(zi)標(biao)準落到實(shi)(shi)處,切(qie)實(shi)(shi)維護(hu)勞(lao)動(dong)者的合(he)法(fa)權益。
