《勞(lao)動(dong)法》第48條規定(ding),國家實行最(zui)(zui)低(di)工資(zi)保障制度,最(zui)(zui)低(di)工資(zi)的具體標準由省、自治區(qu)、直轄市人民政府規定(ding)。原勞(lao)動(dong)保障部(bu)頒布(bu)《最(zui)(zui)低(di)工資(zi)規定(ding)》,明確最(zui)(zui)低(di)工資(zi)標準每兩(liang)年至(zhi)少(shao)調整一次。《國務院批(pi)轉(zhuan)發改委等部(bu)門關于深(shen)化收入(ru)分配制度改革的若干(gan)意見的通知(zhi)》要求,根(gen)據經濟發展、物價(jia)變動(dong)等因素,適時(shi)調整最(zui)(zui)低(di)工資(zi)標準。
2019山東最低工資標準
根據山東省人民政府《關(guan)于公布全(quan)(quan)省最(zui)低(di)工資標(biao)準的通知》山東省決定從2018年6月1日起對(dui)全(quan)(quan)省各市(shi)最(zui)低(di)工資標(biao)準調整如下:
一、調整后的全省月(yue)最(zui)低工(gong)(gong)資標準(zhun)(zhun)為1910元、1730元、1550元;小(xiao)時(shi)最(zui)低工(gong)(gong)資標準(zhun)(zhun)為19.1元、17.3元、15.5元(各市最(zui)低工(gong)(gong)資標準(zhun)(zhun)見(jian)附圖)。
二(er)、月最低工(gong)資標(biao)準適(shi)用于全(quan)日(ri)制(zhi)就業勞動者;小時(shi)最低工(gong)資標(biao)準適(shi)用于非(fei)全(quan)日(ri)制(zhi)就業勞動者。
三、各地要加(jia)強對(dui)(dui)《最(zui)低(di)工(gong)資規(gui)定(ding)》(原勞(lao)(lao)動和社會保障部令(ling)第21號(hao))和最(zui)低(di)工(gong)資標(biao)準(zhun)的宣(xuan)傳,在(zai)當地主要媒(mei)體上公布最(zui)低(di)工(gong)資標(biao)準(zhun),讓用人(ren)單位、勞(lao)(lao)動者和公眾(zhong)廣為了解。要進一步(bu)加(jia)強對(dui)(dui)用人(ren)單位執行(xing)最(zui)低(di)工(gong)資標(biao)準(zhun)情(qing)況的監督(du)檢查,依法(fa)查處違反《最(zui)低(di)工(gong)資規(gui)定(ding)》的行(xing)為,切實維護勞(lao)(lao)動者合法(fa)權益。
另:最低工(gong)資≠標準工(gong)資
值得注(zhu)意(yi)的(de)(de)(de)是(shi),最(zui)低工(gong)(gong)資(zi)(zi)(zi)(zi)標(biao)(biao)準(zhun)不包含延長工(gong)(gong)作時間工(gong)(gong)資(zi)(zi)(zi)(zi),中(zhong)班(ban)、夜班(ban)、高溫、低溫、井下(xia)、有毒有害等特殊工(gong)(gong)作環境、條件(jian)下(xia)的(de)(de)(de)津(jin)貼(tie),以及法律(lv)、法規和(he)(he)國家(jia)規定的(de)(de)(de)勞動者(zhe)福利(li)待遇等。對勞動者(zhe)包吃(chi)住屬于用人(ren)單位給予(yu)職工(gong)(gong)的(de)(de)(de)福利(li),用人(ren)單位不能將此計(ji)算在工(gong)(gong)資(zi)(zi)(zi)(zi)之(zhi)內,更(geng)不能因此使支付(fu)的(de)(de)(de)貨幣工(gong)(gong)資(zi)(zi)(zi)(zi)低于最(zui)低工(gong)(gong)資(zi)(zi)(zi)(zi)標(biao)(biao)準(zhun)。實行(xing)計(ji)件(jian)工(gong)(gong)資(zi)(zi)(zi)(zi)制(zhi)的(de)(de)(de)用人(ren)單位必(bi)須(xu)科(ke)學合理制(zhi)定勞動定額(e)(e),確定基(ji)本計(ji)件(jian)單價和(he)(he)超額(e)(e)計(ji)件(jian)單價,勞動者(zhe)提供(gong)正(zheng)常(chang)勞動并按基(ji)本計(ji)件(jian)單價計(ji)算的(de)(de)(de)工(gong)(gong)資(zi)(zi)(zi)(zi),不得低于最(zui)低工(gong)(gong)資(zi)(zi)(zi)(zi)標(biao)(biao)準(zhun)。勞動者(zhe)個人(ren)應當繳納的(de)(de)(de)社會保險費(fei)和(he)(he)住房公積金包含在最(zui)低工(gong)(gong)資(zi)(zi)(zi)(zi)標(biao)(biao)準(zhun)之(zhi)內。
山東2018年企業工資指導線
山東省人民政府還發布了2018年企業工資指導線,其中增長上線為11%、基準線為7%、下線為3%。這是山東連續9年調整(zheng)最低工(gong)資標準,連續20年發布企(qi)業工(gong)資指導線。
企(qi)(qi)(qi)(qi)業工(gong)資指導線是企(qi)(qi)(qi)(qi)業與職工(gong)開展工(gong)資集體(ti)協商的重(zhong)(zhong)要基(ji)礎。企(qi)(qi)(qi)(qi)業薪酬(chou)調(diao)查(cha)數據顯示(shi),山(shan)東省企(qi)(qi)(qi)(qi)業人(ren)工(gong)成(cheng)(cheng)本(ben)在全國處于中(zhong)等偏下水平(ping),2011—2016年山(shan)東省企(qi)(qi)(qi)(qi)業人(ren)工(gong)成(cheng)(cheng)本(ben)占總(zong)(zong)成(cheng)(cheng)本(ben)比重(zhong)(zhong)為(wei)12.25%,其中(zhong)勞動(dong)報酬(chou)占總(zong)(zong)成(cheng)(cheng)本(ben)比重(zhong)(zhong)為(wei)8.5%,社會保險費用占總(zong)(zong)成(cheng)(cheng)本(ben)比重(zhong)(zhong)為(wei)1.9%,企(qi)(qi)(qi)(qi)業職工(gong)工(gong)資仍有一定的增(zeng)長(chang)空間。
