勞資(zi)(zi)糾紛也稱為勞動爭議,是(shi)指(zhi)勞動者(zhe)(員(yuan)工)與投資(zi)(zi)者(zhe)(用人(ren)單位)之間(jian)由于種種利益沖突(tu)而發(fa)生的糾紛。
雇工(gong)與雇主(zhu)因(yin)工(gong)資(zi)(zi)(zi),工(gong)時,勞動條件,解(jie)雇等原因(yin)所產生(sheng)(sheng)的糾(jiu)(jiu)紛。在(zai)資(zi)(zi)(zi)本主(zhu)義(yi)制(zhi)度(du)下(xia),是(shi)工(gong)人(ren)階級與資(zi)(zi)(zi)產階級之間矛盾的產物,嚴重(zhong)時往往以罷(ba)工(gong)形式(shi)出現。中華人(ren)民共(gong)和國成立初期(qi),私(si)營企(qi)業(ye)(ye)中也有勞資(zi)(zi)(zi)糾(jiu)(jiu)紛,中國共(gong)產黨與人(ren)民政府(fu)根據“發(fa)展生(sheng)(sheng)產、繁(fan)榮經濟、公(gong)私(si)兼顧、勞資(zi)(zi)(zi)兩利”的方針(zhen)予以解(jie)決。現階段,外資(zi)(zi)(zi)企(qi)業(ye)(ye)、私(si)人(ren)企(qi)業(ye)(ye)中存(cun)在(zai)的勞資(zi)(zi)(zi)糾(jiu)(jiu)紛,納入勞動爭議的處(chu)理程(cheng)序(xu)予以解(jie)決。
勞資糾紛類型
1、因(yin)企業開除、除名、辭退職(zhi)(zhi)工和職(zhi)(zhi)工辭職(zhi)(zhi)、自動離職(zhi)(zhi)發(fa)生的爭議;
2、因執行國家有關工資(zi)、保險、福利、培(pei)訓、勞動保護(hu)的規定發(fa)生(sheng)的爭議;
3、因(yin)履行(xing)勞動合同(tong)發生的爭議;
4、法律、法規規定應當依照本(ben)條例處理(li)的其它勞動爭議。
勞資糾紛的表現形式
1、因用人單位拖欠、克扣、截留勞動者工資,壓低計件工價引發勞動爭議。一些用人單位未依法按月以貨幣的形式發放給勞動者的勞動報酬,每月只預借生活費甚至只發給餐菜票代生活費;有的用人單位接到生產訂單后未公布計價單價就立即安排生產,在完成訂單生產任務后也不公布計價單價,而在年終結算工資時壓低計件工資;有的用人單位在春節期間(jian)截留一個月工(gong)(gong)資(zi)待(dai)春節過后(hou)勞(lao)動(dong)者(zhe)回來(lai)工(gong)(gong)作才發放,以(yi)維(wei)持企業的(de)正常生產;部分建筑企業因工(gong)(gong)程(cheng)款(kuan)不(bu)到位拖欠(qian)農(nong)民(min)工(gong)(gong)工(gong)(gong)資(zi)或勞(lao)動(dong)用工(gong)(gong)不(bu)規范,工(gong)(gong)程(cheng)勞(lao)務層(ceng)層(ceng)轉包分包,導致班組(zu)長侵吞工(gong)(gong)人工(gong)(gong)資(zi)后(hou)攜款(kuan)外逃,引發勞(lao)動(dong)者(zhe)集體上訪,造成(cheng)惡劣影響;有(you)的(de)用人單(dan)位生產經(jing)營不(bu)景氣,虧損嚴重,時常拖欠(qian)職工(gong)(gong)工(gong)(gong)資(zi),個別企業主(zhu)則(ze)采取攜款(kuan)逃匿的(de)做法逃避支付職工(gong)(gong)工(gong)(gong)資(zi)。
2、因履行勞動合同而引發大量的勞動爭議。《勞動法》頒布實施后(hou)建立了(le)以(yi)簽訂勞動合同(tong)為主(zhu)的新型勞動用(yong)工制度。用(yong)人單位(wei)與勞動者(zhe)在履行勞動合同(tong)中,用(yong)人單位(wei)無故辭退(tui)職工不支付(fu)(fu)經(jing)濟補償金,勞動者(zhe)擅自“跳槽”不支付(fu)(fu)違約金等情況屢有發生。
勞資糾紛怎么處理
1、通過雙方協商解決勞動爭議
由勞動(dong)者與用人單位協(xie)商,或者請(qing)工會(hui)(第三方)共同(tong)與用人單位協(xie)商,達成和解(jie)協(xie)議(yi),并(bing)履行(xing)和解(jie)協(xie)議(yi)。不能達成和解(jie)協(xie)議(yi)或者不履行(xing)和解(jie)協(xie)議(yi)的,當事人可(ke)以申(shen)請(qing)調解(jie)或者勞動(dong)仲裁。
2、通過調解途徑解決勞動爭議
勞動(dong)爭議的(de)調(diao)解組織包括企業勞動(dong)爭議調(diao)解委員(yuan)會、依(yi)法設(she)立的(de)基(ji)層人民調(diao)解組織以及在鄉鎮街道設(she)立的(de)具有(you)勞動(dong)爭議調(diao)解職能的(de)組織。
發(fa)生(sheng)勞動(dong)爭(zheng)議后,用人單(dan)位與勞動(dong)者都可以(yi)向上(shang)述調解(jie)組織提出(chu)調解(jie)申請(qing)(qing)。提出(chu)勞動(dong)爭(zheng)議調解(jie)申請(qing)(qing)可以(yi)書(shu)面申請(qing)(qing),也可以(yi)口頭(tou)申請(qing)(qing)。
經(jing)(jing)調(diao)(diao)(diao)解達成協(xie)(xie)(xie)議(yi)的,應當(dang)制(zhi)作調(diao)(diao)(diao)解協(xie)(xie)(xie)議(yi)書,調(diao)(diao)(diao)解協(xie)(xie)(xie)議(yi)書由雙方(fang)當(dang)事(shi)(shi)人(ren)簽名或(huo)者蓋章,經(jing)(jing)調(diao)(diao)(diao)解員(yuan)簽名并加蓋調(diao)(diao)(diao)解組織印(yin)章后生效,對雙方(fang)當(dang)事(shi)(shi)人(ren)具有約(yue)束力(li),當(dang)事(shi)(shi)人(ren)應當(dang)履行(xing)。一方(fang)當(dang)事(shi)(shi)人(ren)在協(xie)(xie)(xie)議(yi)約(yue)定期限(xian)內(nei)不(bu)履行(xing)調(diao)(diao)(diao)解協(xie)(xie)(xie)議(yi)的,另一方(fang)當(dang)事(shi)(shi)人(ren)可以(yi)依法(fa)(fa)申(shen)(shen)請(qing)勞(lao)動仲(zhong)裁。自勞(lao)動爭議(yi)調(diao)(diao)(diao)解組織收到調(diao)(diao)(diao)解申(shen)(shen)請(qing)之日起十五(wu)日內(nei)未達成調(diao)(diao)(diao)解協(xie)(xie)(xie)議(yi)的,用人(ren)單(dan)位(wei)與勞(lao)動者都可以(yi)申(shen)(shen)請(qing)勞(lao)動仲(zhong)裁。因支付(fu)拖欠勞(lao)動報酬、工傷(shang)醫療費、經(jing)(jing)濟補償或(huo)者賠償金(jin)事(shi)(shi)項達成調(diao)(diao)(diao)解協(xie)(xie)(xie)議(yi),用人(ren)單(dan)位(wei)在協(xie)(xie)(xie)議(yi)約(yue)定期限(xian)內(nei)不(bu)履行(xing)的,勞(lao)動者可以(yi)持調(diao)(diao)(diao)解協(xie)(xie)(xie)議(yi)書依法(fa)(fa)向人(ren)民法(fa)(fa)院申(shen)(shen)請(qing)支付(fu)令(ling),人(ren)民法(fa)(fa)院應當(dang)依法(fa)(fa)發出(chu)支付(fu)令(ling)。
3、通過勞動仲裁途徑解決勞動爭議
勞(lao)動(dong)爭議仲裁(cai)的(de)管轄、當事人(ren)勞(lao)動(dong)爭議仲裁(cai)由勞(lao)動(dong)合同履行地或者(zhe)用人(ren)單位(wei)(wei)所在地的(de)勞(lao)動(dong)爭議仲裁(cai)委員會(hui)管轄,用人(ren)單位(wei)(wei)與勞(lao)動(dong)者(zhe)分別向勞(lao)動(dong)合同履行地和(he)用人(ren)單位(wei)(wei)所在地的(de)勞(lao)動(dong)爭議仲裁(cai)委員會(hui)申(shen)請(qing)仲裁(cai)的(de),由勞(lao)動(dong)合同履行地的(de)勞(lao)動(dong)爭議仲裁(cai)委員會(hui)管轄。
發(fa)生(sheng)勞(lao)(lao)(lao)動(dong)爭議(yi)(yi)(yi)的(de)勞(lao)(lao)(lao)動(dong)者和用(yong)人(ren)單(dan)(dan)位(wei)為勞(lao)(lao)(lao)動(dong)爭議(yi)(yi)(yi)仲(zhong)裁(cai)(cai)案(an)件的(de)雙方當事人(ren)。勞(lao)(lao)(lao)務(wu)派遣單(dan)(dan)位(wei)或者用(yong)工(gong)(gong)單(dan)(dan)位(wei)與勞(lao)(lao)(lao)動(dong)者發(fa)生(sheng)勞(lao)(lao)(lao)動(dong)爭議(yi)(yi)(yi)的(de),勞(lao)(lao)(lao)務(wu)派遣單(dan)(dan)位(wei)和用(yong)工(gong)(gong)單(dan)(dan)位(wei)為共同當事人(ren)。與勞(lao)(lao)(lao)動(dong)爭議(yi)(yi)(yi)案(an)件的(de)處理結果有利害關(guan)系(xi)的(de)第三人(ren),可(ke)以主(zhu)動(dong)申請參加仲(zhong)裁(cai)(cai)活(huo)動(dong),也(ye)可(ke)以由勞(lao)(lao)(lao)動(dong)爭議(yi)(yi)(yi)仲(zhong)裁(cai)(cai)委員會通知其(qi)參加仲(zhong)裁(cai)(cai)活(huo)動(dong)。
勞(lao)動(dong)爭(zheng)(zheng)議(yi)仲(zhong)(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)公開進行(xing),但當(dang)(dang)(dang)事(shi)人(ren)(ren)協(xie)議(yi)不(bu)公開進行(xing)或(huo)(huo)者(zhe)涉及國家(jia)秘密、商(shang)業秘密和(he)個人(ren)(ren)隱私的可(ke)(ke)以(yi)不(bu)公開進行(xing)。勞(lao)動(dong)爭(zheng)(zheng)議(yi)仲(zhong)(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)的申(shen)(shen)(shen)請(qing)(qing)(qing)和(he)受理(li)勞(lao)動(dong)爭(zheng)(zheng)議(yi)申(shen)(shen)(shen)請(qing)(qing)(qing)仲(zhong)(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)的時(shi)(shi)效期(qi)(qi)間為一年,從當(dang)(dang)(dang)事(shi)人(ren)(ren)知(zhi)(zhi)道或(huo)(huo)者(zhe)應(ying)當(dang)(dang)(dang)知(zhi)(zhi)道其(qi)(qi)權利被侵害之日(ri)(ri)起(qi)計算。仲(zhong)(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)時(shi)(shi)效因當(dang)(dang)(dang)事(shi)人(ren)(ren)一方(fang)向對(dui)方(fang)當(dang)(dang)(dang)事(shi)人(ren)(ren)主張權利、或(huo)(huo)者(zhe)向有(you)關(guan)部門請(qing)(qing)(qing)求權利救(jiu)濟(ji)、或(huo)(huo)者(zhe)對(dui)方(fang)當(dang)(dang)(dang)事(shi)人(ren)(ren)同意履行(xing)義務而中(zhong)斷。因不(bu)可(ke)(ke)抗力或(huo)(huo)者(zhe)其(qi)(qi)他正當(dang)(dang)(dang)理(li)由,當(dang)(dang)(dang)事(shi)人(ren)(ren)不(bu)能在規(gui)定的仲(zhong)(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)時(shi)(shi)效期(qi)(qi)間申(shen)(shen)(shen)請(qing)(qing)(qing)仲(zhong)(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)的,仲(zhong)(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)時(shi)(shi)效中(zhong)止(zhi)。勞(lao)動(dong)關(guan)系存續期(qi)(qi)間因拖欠勞(lao)動(dong)報酬發生(sheng)爭(zheng)(zheng)議(yi)的,勞(lao)動(dong)者(zhe)申(shen)(shen)(shen)請(qing)(qing)(qing)仲(zhong)(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)不(bu)受一年仲(zhong)(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)時(shi)(shi)效期(qi)(qi)間的限制。但勞(lao)動(dong)關(guan)系終止(zhi)的,應(ying)當(dang)(dang)(dang)自勞(lao)動(dong)關(guan)系終止(zhi)之日(ri)(ri)起(qi)一年內提出(chu)。申(shen)(shen)(shen)請(qing)(qing)(qing)人(ren)(ren)申(shen)(shen)(shen)請(qing)(qing)(qing)勞(lao)動(dong)仲(zhong)(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)應(ying)當(dang)(dang)(dang)提交書面仲(zhong)(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)申(shen)(shen)(shen)請(qing)(qing)(qing),書寫仲(zhong)(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)申(shen)(shen)(shen)請(qing)(qing)(qing)確有(you)困難(nan)的,可(ke)(ke)以(yi)口(kou)頭申(shen)(shen)(shen)請(qing)(qing)(qing)。勞(lao)動(dong)爭(zheng)(zheng)議(yi)仲(zhong)(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)委(wei)(wei)員(yuan)會(hui)收到仲(zhong)(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)申(shen)(shen)(shen)請(qing)(qing)(qing)之日(ri)(ri)起(qi)五日(ri)(ri)內決定是否受理(li)。對(dui)勞(lao)動(dong)爭(zheng)(zheng)議(yi)仲(zhong)(zhong)(zhong)(zhong)(zhong)裁(cai)(cai)(cai)委(wei)(wei)員(yuan)會(hui)不(bu)予受理(li)或(huo)(huo)者(zhe)逾期(qi)(qi)未作(zuo)出(chu)決定的,申(shen)(shen)(shen)請(qing)(qing)(qing)人(ren)(ren)可(ke)(ke)以(yi)就該勞(lao)動(dong)爭(zheng)(zheng)議(yi)事(shi)項向人(ren)(ren)民法(fa)院提起(qi)訴訟。
勞動爭議仲裁的開庭和裁決
勞動(dong)爭議(yi)(yi)仲裁(cai)委員會裁(cai)決勞動(dong)爭議(yi)(yi)案件(jian)實(shi)行仲裁(cai)庭(ting)(ting)制。仲裁(cai)庭(ting)(ting)應當在開(kai)庭(ting)(ting)五日前將開(kai)庭(ting)(ting)日期、地(di)點書(shu)面通知雙方當事(shi)人,當事(shi)人有正(zheng)當理由的(de),可以在開(kai)庭(ting)(ting)三日前請求延(yan)期開(kai)庭(ting)(ting)。
申請人收到(dao)(dao)書(shu)面(mian)通(tong)知(zhi),無正(zheng)當理(li)由(you)拒不到(dao)(dao)庭(ting)或者未(wei)經仲裁庭(ting)同(tong)意中途退(tui)庭(ting)的,可(ke)以視為撤回仲裁申請。被(bei)申請人收到(dao)(dao)書(shu)面(mian)通(tong)知(zhi),無正(zheng)當理(li)由(you)拒不到(dao)(dao)庭(ting)或者未(wei)經仲裁庭(ting)同(tong)意中途退(tui)庭(ting)的,可(ke)以缺席裁決。
當(dang)(dang)事人(ren)(ren)申請勞(lao)動爭(zheng)議仲裁(cai)(cai)后,可以(yi)自(zi)行(xing)和解(jie)(jie),達(da)成(cheng)和解(jie)(jie)協議的(de),可以(yi)撤(che)回仲裁(cai)(cai)申請。仲裁(cai)(cai)庭(ting)在作(zuo)出(chu)裁(cai)(cai)決(jue)前,應當(dang)(dang)先(xian)行(xing)調(diao)(diao)(diao)解(jie)(jie)。調(diao)(diao)(diao)解(jie)(jie)達(da)成(cheng)協議的(de),仲裁(cai)(cai)庭(ting)應當(dang)(dang)制作(zuo)調(diao)(diao)(diao)解(jie)(jie)書(shu)(shu),調(diao)(diao)(diao)解(jie)(jie)書(shu)(shu)經雙方當(dang)(dang)事人(ren)(ren)簽收(shou)后發生法律效力。調(diao)(diao)(diao)解(jie)(jie)不成(cheng),或者調(diao)(diao)(diao)解(jie)(jie)書(shu)(shu)送達(da)前一方當(dang)(dang)事人(ren)(ren)反悔的(de),仲裁(cai)(cai)庭(ting)應當(dang)(dang)及時作(zuo)出(chu)裁(cai)(cai)決(jue)。
仲裁(cai)(cai)庭裁(cai)(cai)決勞動(dong)爭議案(an)件,應當(dang)(dang)(dang)自勞動(dong)爭議仲裁(cai)(cai)委員會受理仲裁(cai)(cai)申(shen)請之日起四(si)十五日內(nei)結束。案(an)情復雜需(xu)要延期(qi)的,經勞動(dong)爭議仲裁(cai)(cai)委員會主任(ren)批準(zhun),可以(yi)延期(qi)并書面(mian)通(tong)知(zhi)當(dang)(dang)(dang)事人,但是延長期(qi)限不得超過(guo)十五日。逾(yu)期(qi)未作出仲裁(cai)(cai)裁(cai)(cai)決的,當(dang)(dang)(dang)事人可以(yi)就該勞動(dong)爭議事項向(xiang)人民法(fa)院提起訴訟。
對(dui)下(xia)列兩項爭議事項的(de)仲(zhong)裁(cai)裁(cai)決為終局裁(cai)決,裁(cai)決書(shu)自作出之日(ri)起發生(sheng)法律(lv)效力:
(1)追索勞動(dong)報酬(chou)、工(gong)(gong)傷醫療費、經濟補償(chang)或者賠償(chang)金,不超(chao)過當地(di)月最低工(gong)(gong)資標準(zhun)十二(er)個月金額的爭議。
(2)因(yin)執行國家的(de)勞動標(biao)準在工(gong)作時間、休(xiu)息(xi)休(xiu)假(jia)、社會保險等方(fang)面發生的(de)爭議。
勞(lao)(lao)動者對上述兩(liang)項(xiang)爭(zheng)(zheng)議(yi)事(shi)(shi)項(xiang)的(de)(de)(de)(de)仲(zhong)(zhong)(zhong)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)決(jue)(jue)不服的(de)(de)(de)(de),可以(yi)自收(shou)到仲(zhong)(zhong)(zhong)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)決(jue)(jue)書(shu)之(zhi)日起(qi)十五日內(nei)(nei)向(xiang)人(ren)(ren)民(min)法(fa)(fa)(fa)院(yuan)(yuan)提起(qi)訴(su)訟。用人(ren)(ren)單位有證據證明(ming)上述兩(liang)項(xiang)爭(zheng)(zheng)議(yi)事(shi)(shi)項(xiang)的(de)(de)(de)(de)仲(zhong)(zhong)(zhong)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)決(jue)(jue)存在(zai)適用法(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)規確有錯誤、勞(lao)(lao)動爭(zheng)(zheng)議(yi)仲(zhong)(zhong)(zhong)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)委員會(hui)無(wu)管轄(xia)權、違反法(fa)(fa)(fa)定(ding)程(cheng)序、裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)決(jue)(jue)所(suo)根(gen)據的(de)(de)(de)(de)證據是偽造的(de)(de)(de)(de)、對方當事(shi)(shi)人(ren)(ren)隱(yin)瞞了足(zu)以(yi)影響公正裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)決(jue)(jue)的(de)(de)(de)(de)證據、仲(zhong)(zhong)(zhong)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)員在(zai)仲(zhong)(zhong)(zhong)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)該案(an)時有索(suo)賄受賄、徇私舞弊、枉法(fa)(fa)(fa)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)決(jue)(jue)行為的(de)(de)(de)(de),可以(yi)自收(shou)到仲(zhong)(zhong)(zhong)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)決(jue)(jue)書(shu)之(zhi)日起(qi)三十日內(nei)(nei)向(xiang)勞(lao)(lao)動爭(zheng)(zheng)議(yi)仲(zhong)(zhong)(zhong)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)委員會(hui)所(suo)在(zai)地的(de)(de)(de)(de)中級人(ren)(ren)民(min)法(fa)(fa)(fa)院(yuan)(yuan)申請撤銷裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)決(jue)(jue)。對上述兩(liang)項(xiang)爭(zheng)(zheng)議(yi)事(shi)(shi)項(xiang)以(yi)外的(de)(de)(de)(de)其(qi)他勞(lao)(lao)動爭(zheng)(zheng)議(yi)案(an)件(jian)的(de)(de)(de)(de)仲(zhong)(zhong)(zhong)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)決(jue)(jue)不服的(de)(de)(de)(de),當事(shi)(shi)人(ren)(ren)可以(yi)自收(shou)到仲(zhong)(zhong)(zhong)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)決(jue)(jue)書(shu)之(zhi)日起(qi)十五日內(nei)(nei)向(xiang)人(ren)(ren)民(min)法(fa)(fa)(fa)院(yuan)(yuan)提起(qi)訴(su)訟,期滿不起(qi)訴(su)的(de)(de)(de)(de),裁(cai)(cai)(cai)(cai)(cai)(cai)(cai)決(jue)(jue)書(shu)發生(sheng)法(fa)(fa)(fa)律(lv)效力。
勞動爭議調解書、裁決書的執行
當事(shi)人對發(fa)生法(fa)律效力的(de)(de)(de)調解書(shu)、裁(cai)決書(shu)應(ying)當依照規(gui)定的(de)(de)(de)期(qi)限履行(xing),一方當事(shi)人逾(yu)期(qi)不(bu)履行(xing)的(de)(de)(de),另一方當事(shi)人可(ke)以依照《中華人民共和國民事(shi)訴訟法(fa)》的(de)(de)(de)有關規(gui)定向人民法(fa)院(yuan)申請執行(xing),受理申請的(de)(de)(de)人民法(fa)院(yuan)應(ying)當依法(fa)執行(xing)。
