中國律(lv)師(shi)事務(wu)所(suo)(suo)(suo)所(suo)(suo)(suo)表現(xian)的(de)(de)波動性以及(ji)增長瓶頸,主要(yao)是因(yin)(yin)為律(lv)師(shi)事務(wu)所(suo)(suo)(suo)業(ye)務(wu)選擇偏(pian)(pian)重訴(su)訟、企業(ye)組織流(liu)于形式、主導能力素質偏(pian)(pian)低、創新內容又僅限(xian)于業(ye)務(wu)等。因(yin)(yin)此律(lv)師(shi)事務(wu)所(suo)(suo)(suo)要(yao)取得更大的(de)(de)發展,必須提倡科學的(de)(de)人力資源管理、重視(shi)軟硬(ying)件的(de)(de)共同建設、律(lv)所(suo)(suo)(suo)資源的(de)(de)合理分配、以及(ji)要(yao)認識到律(lv)師(shi)事務(wu)所(suo)(suo)(suo)與傳統企業(ye)的(de)(de)結構(gou)差別(bie)等。
律師事務所設立條件
2008年新的《中華人民共和國律師法》第十四條規定:律師法第十四條規定:律師事務所是律師的執業(ye)機(ji)構。設(she)立律師事(shi)務所應當具備下列條件:
(1)有自己的(de)名稱、住所和章(zhang)程;
(2)有符合(he)本(ben)法(fa)規定的律師;
(3)設立人應(ying)當(dang)是具(ju)有一定的執業經歷,且(qie)三年內未受(shou)過停(ting)止執業處罰的律師;
(4)有符合國務院(yuan)司(si)法行(xing)政(zheng)部門規定(ding)數額的(de)資產(chan)。
律師事務所收費標準
1、律(lv)(lv)(lv)(lv)(lv)師(shi)(shi)事(shi)(shi)務(wu)(wu)(wu)(wu)所接受委托(tuo)代(dai)理民事(shi)(shi)案(an)(an)件(jian)(jian)(jian)、行政案(an)(an)件(jian)(jian)(jian)、刑事(shi)(shi)案(an)(an)件(jian)(jian)(jian)、仲(zhong)裁(cai)案(an)(an)件(jian)(jian)(jian),其收(shou)費(fei)實行政府指(zhi)導(dao)價管理。收(shou)費(fei)標(biao)(biao)準(zhun)(zhun)(zhun)分為:一(yi)(yi)般性(xing)案(an)(an)件(jian)(jian)(jian)律(lv)(lv)(lv)(lv)(lv)師(shi)(shi)服務(wu)(wu)(wu)(wu)收(shou)費(fei)標(biao)(biao)準(zhun)(zhun)(zhun)和(he)重大(da)、疑(yi)難(nan)、復(fu)雜案(an)(an)件(jian)(jian)(jian)律(lv)(lv)(lv)(lv)(lv)師(shi)(shi)服務(wu)(wu)(wu)(wu)收(shou)費(fei)標(biao)(biao)準(zhun)(zhun)(zhun)。一(yi)(yi)般性(xing)案(an)(an)件(jian)(jian)(jian)律(lv)(lv)(lv)(lv)(lv)師(shi)(shi)服務(wu)(wu)(wu)(wu)收(shou)費(fei)標(biao)(biao)準(zhun)(zhun)(zhun)詳(xiang)見附件(jian)(jian)(jian)一(yi)(yi)執行。重大(da)、疑(yi)難(nan)、復(fu)雜案(an)(an)件(jian)(jian)(jian)律(lv)(lv)(lv)(lv)(lv)師(shi)(shi)服務(wu)(wu)(wu)(wu)收(shou)費(fei)標(biao)(biao)準(zhun)(zhun)(zhun)由律(lv)(lv)(lv)(lv)(lv)師(shi)(shi)事(shi)(shi)務(wu)(wu)(wu)(wu)所按(an)不(bu)超過一(yi)(yi)般性(xing)案(an)(an)件(jian)(jian)(jian)服務(wu)(wu)(wu)(wu)收(shou)費(fei)標(biao)(biao)準(zhun)(zhun)(zhun)最(zui)高(gao)標(biao)(biao)準(zhun)(zhun)(zhun)5倍的(de)幅度內與委托(tuo)人協商(shang)確(que)定(ding)具體標(biao)(biao)準(zhun)(zhun)(zhun)。重大(da)、疑(yi)難(nan)、復(fu)雜案(an)(an)件(jian)(jian)(jian)的(de)范(fan)圍界(jie)定(ding)詳(xiang)見附件(jian)(jian)(jian)二。同一(yi)(yi)律(lv)(lv)(lv)(lv)(lv)師(shi)(shi)事(shi)(shi)務(wu)(wu)(wu)(wu)所接受同一(yi)(yi)刑事(shi)(shi)、民事(shi)(shi)、行政案(an)(an)件(jian)(jian)(jian)一(yi)(yi)、二審代(dai)理人(辯護人)的(de),二審服務(wu)(wu)(wu)(wu)收(shou)費(fei)標(biao)(biao)準(zhun)(zhun)(zhun)按(an)不(bu)高(gao)于一(yi)(yi)審服務(wu)(wu)(wu)(wu)收(shou)費(fei)標(biao)(biao)準(zhun)(zhun)(zhun)的(de)70%的(de)幅度內收(shou)取。律(lv)(lv)(lv)(lv)(lv)師(shi)(shi)事(shi)(shi)務(wu)(wu)(wu)(wu)所代(dai)理各種訴(su)訟(song)案(an)(an)件(jian)(jian)(jian)的(de)申(shen)訴(su)按(an)不(bu)高(gao)于一(yi)(yi)審律(lv)(lv)(lv)(lv)(lv)師(shi)(shi)服務(wu)(wu)(wu)(wu)收(shou)費(fei)標(biao)(biao)準(zhun)(zhun)(zhun)由律(lv)(lv)(lv)(lv)(lv)師(shi)(shi)事(shi)(shi)務(wu)(wu)(wu)(wu)所與委托(tuo)方(fang)協商(shang)收(shou)費(fei)。
2、除實(shi)行政府指導價管理的律(lv)(lv)(lv)師(shi)(shi)(shi)服(fu)(fu)務(wu)(wu)(wu)(wu)收(shou)(shou)(shou)費(fei)外,其它(ta)(ta)律(lv)(lv)(lv)師(shi)(shi)(shi)服(fu)(fu)務(wu)(wu)(wu)(wu)收(shou)(shou)(shou)費(fei)標準由(you)律(lv)(lv)(lv)師(shi)(shi)(shi)事(shi)務(wu)(wu)(wu)(wu)所與委托(tuo)方協(xie)商確(que)定。律(lv)(lv)(lv)師(shi)(shi)(shi)事(shi)務(wu)(wu)(wu)(wu)所可(ke)決定實(shi)行計(ji)(ji)(ji)件制(zhi)(zhi)或計(ji)(ji)(ji)時(shi)制(zhi)(zhi)收(shou)(shou)(shou)費(fei)方式。計(ji)(ji)(ji)時(shi)收(shou)(shou)(shou)費(fei)的金額按律(lv)(lv)(lv)師(shi)(shi)(shi)辦理法(fa)(fa)律(lv)(lv)(lv)事(shi)務(wu)(wu)(wu)(wu)的計(ji)(ji)(ji)費(fei)工(gong)作時(shi)間(jian)和計(ji)(ji)(ji)時(shi)收(shou)(shou)(shou)費(fei)標準確(que)定。計(ji)(ji)(ji)費(fei)工(gong)作時(shi)間(jian)是律(lv)(lv)(lv)師(shi)(shi)(shi)辦理法(fa)(fa)律(lv)(lv)(lv)事(shi)務(wu)(wu)(wu)(wu)的有效力(li)工(gong)作時(shi)間(jian)(以(yi)小時(shi)為單(dan)位),包括律(lv)(lv)(lv)師(shi)(shi)(shi)向(xiang)委托(tuo)人(ren)了解案(an)情、調查取證、查閱案(an)卷、起草(cao)訴(su)訟文書(shu)和法(fa)(fa)律(lv)(lv)(lv)文件,會見(jian)被限制(zhi)(zhi)人(ren)身(shen)自(zi)由(you)的人(ren)員、出庭、參與調解和談(tan)判(pan)、代辦各類手續以(yi)及辦理其它(ta)(ta)相(xiang)關的法(fa)(fa)律(lv)(lv)(lv)事(shi)務(wu)(wu)(wu)(wu)的時(shi)間(jian)。辦理各類法(fa)(fa)律(lv)(lv)(lv)事(shi)務(wu)(wu)(wu)(wu)的計(ji)(ji)(ji)費(fei)工(gong)作時(shi)間(jian)由(you)省律(lv)(lv)(lv)師(shi)(shi)(shi)協(xie)會向(xiang)社會公布,供律(lv)(lv)(lv)師(shi)(shi)(shi)事(shi)務(wu)(wu)(wu)(wu)所和委托(tuo)方參考。律(lv)(lv)(lv)師(shi)(shi)(shi)個人(ren)的計(ji)(ji)(ji)時(shi)收(shou)(shou)(shou)費(fei)標準由(you)律(lv)(lv)(lv)師(shi)(shi)(shi)事(shi)務(wu)(wu)(wu)(wu)所根(gen)據律(lv)(lv)(lv)師(shi)(shi)(shi)的執業年限、服(fu)(fu)務(wu)(wu)(wu)(wu)能力(li)、社會信譽等因素確(que)定。
3、律(lv)師(shi)為委(wei)(wei)(wei)托人(ren)提(ti)(ti)供(gong)法(fa)律(lv)服(fu)務(wu),不(bu)得私(si)自(zi)收(shou)費(fei)(fei),應(ying)由律(lv)師(shi)事(shi)務(wu)所(suo)(suo)與委(wei)(wei)(wei)托人(ren)簽訂協(xie)議(yi)。協(xie)議(yi)中有(you)關收(shou)費(fei)(fei)的條款(kuan)應(ying)對(dui)(dui)收(shou)費(fei)(fei)方式、收(shou)費(fei)(fei)標準及收(shou)費(fei)(fei)總額、付款(kuan)方式等予以明確(que)。委(wei)(wei)(wei)托人(ren)要求(qiu)提(ti)(ti)供(gong)費(fei)(fei)用(yong)(yong)(yong)概算(suan)要求(qiu)的,律(lv)師(shi)事(shi)務(wu)所(suo)(suo)應(ying)予以提(ti)(ti)供(gong)。需預(yu)收(shou)律(lv)師(shi)服(fu)務(wu)費(fei)(fei)的,應(ying)對(dui)(dui)預(yu)收(shou)費(fei)(fei)用(yong)(yong)(yong)及用(yong)(yong)(yong)途在協(xie)議(yi)中予以明確(que)。律(lv)師(shi)事(shi)務(wu)所(suo)(suo)收(shou)到預(yu)收(shou)費(fei)(fei)用(yong)(yong)(yong)后(hou),律(lv)師(shi)事(shi)務(wu)所(suo)(suo)應(ying)當向委(wei)(wei)(wei)托人(ren)予以書(shu)面確(que)認,未(wei)經委(wei)(wei)(wei)托人(ren)同意,律(lv)師(shi)事(shi)務(wu)所(suo)(suo)不(bu)得改變預(yu)收(shou)費(fei)(fei)用(yong)(yong)(yong)的用(yong)(yong)(yong)途。
4、律師事務所(suo)收(shou)費(fei)(fei)前應到同級價格(ge)部門辦理《收(shou)費(fei)(fei)許可證》,實行亮(liang)證收(shou)費(fei)(fei),收(shou)費(fei)(fei)使用稅務票據。
